A Florida man is on trial for a death of a homeowner during a robbery. But it was cops that shot and killed the victim

Cristian Duran-Contreras is on trial for the death of Jose Luis Lopez during a robbery, but police officers are the ones who shot and killed Lopez. The incident occurred when police responded to a reported break-in at Lopez's Orlando home. Upon arrival, officers found Duran-Contreras and Lopez struggling inside. Believing Lopez was armed with a knife, officers ordered him to drop it before firing three shots, fatally wounding Lopez. A search of the scene did not yield any knife or weapon. Despite not firing the fatal shots, Duran-Contreras faces murder charges under Florida law because Lopez's death occurred during the alleged commission of a felony, burglary. The officers who fired the shots have not been charged. The defense argues that Lopez was not armed and was attempting to communicate with the deputies, but his lack of English proficiency hindered his efforts. Duran-Contreras and Lopez were co-workers and had been drinking together at Lopez's home. A dispute reportedly arose, leading to Lopez calling 911 believing someone was trying to break into his house, which turned out to be Duran-Contreras attempting to re-enter.
